1. Agreement to Terms
By engaging with Geeta Holidays Pvt Ltd ("the Company," "we," "us") for any travel-related service, including but not limited to browsing our website, requesting a quote, or making a booking, you, the customer ("you," "the traveler"), acknowledge, accept, and agree to be unequivocally bound by these Terms and Conditions. This document constitutes a legally binding contract. If you do not agree with any part of these terms, you must not use our services.
2. Bookings, Payments, and Pricing
- Booking Confirmation: All quotations are provisional and subject to availability at the time of booking. A booking is considered confirmed only upon receipt of the specified advance payment by the Company and the subsequent issuance of a formal confirmation invoice from us.
- Payment Schedule: A non-refundable, non-transferable deposit, as specified at the time of quotation, is required to secure a booking. The final balance must be paid in full no later than 45 days prior to the departure date, unless otherwise specified. Failure to remit the final payment by the stipulated deadline constitutes a cancellation by you, resulting in the forfeiture of all amounts previously paid.
- Pricing and Surcharges: Prices are quoted per person and are subject to change without prior notice until full payment has been received. We reserve the right to impose surcharges due to factors beyond our control, such as currency fluctuations, increases in government taxes, airline fuel surcharges, or other operational cost increases. Quoted prices explicitly exclude visa fees, travel insurance, items of a personal nature (e.g., laundry, telephone calls), and any services not expressly itemized in the travel itinerary.
3. Cancellation, Refunds, and Amendments
- Cancellation by You: All cancellation requests must be made in writing and will be effective from the date of receipt by the Company. Cancellation charges are applied as follows:
- More than 45 days before departure: Forfeiture of the full non-refundable deposit.
- 31-45 days before departure: 50% of the total booking cost will be charged.
- 30 days or less before departure, or a "no-show": 100% of the total booking cost will be charged (no refund).
- Third-Party Supplier Policies: Airline tickets, once issued, are typically non-refundable and non-transferable. Hotel and other supplier cancellation policies are separate and will be applied in addition to our own. The Company is not responsible for any charges or policies levied by third parties. Any refunds, if applicable, will only be processed after we have received the corresponding refund from our suppliers, a process which can take several months.
- Cancellation or Alteration by Us: We reserve the absolute right to cancel or modify any trip for any reason, including force majeure events (as defined in Section 6) or insufficient participation. In such an event, our liability is strictly limited to offering a comparable alternative trip or a full refund of the monies paid directly to us. We shall not be liable for any other costs or expenses incurred by you, such as visa fees or connecting flight costs.
4. Traveler's Responsibilities
- Travel Documents & Health: You are solely responsible for ensuring that all travel documents, including passports (with a minimum of 6 months validity from the return date), visas, and health/vaccination certificates, are valid and in order for all countries to be visited. We provide visa assistance as a facilitation service but bear no liability for the denial of a visa or entry into any country.
- Travel Insurance: The purchase of comprehensive travel and medical insurance is mandatory for all international travel and highly recommended for domestic travel. You are responsible for ensuring your policy provides adequate coverage for trip cancellation, medical emergencies, personal liability, and loss of property for the full duration of your trip.
- Conduct and Compliance: You agree to abide by the laws and customs of all countries visited and to conduct yourself in a manner that does not endanger the safety or comfort of other travelers or our representatives. We reserve the right to remove any traveler from a trip for illegal, disruptive, or dangerous behavior, at the traveler's own expense and without any right to a refund.
5. Limitation of Liability and Indemnification
Geeta Holidays Pvt Ltd acts solely as an agent for third-party suppliers (e.g., airlines, hotels, transport providers). We do not own, operate, or control these services. All bookings are subject to the terms and conditions of these third-party suppliers.
The Company, its directors, employees, agents, and affiliates shall not be liable for any injury, death, loss, damage, accident, delay, inconvenience, or any other irregularity that may be caused by: (a) any wrongful, negligent, or unauthorized acts or omissions on the part of any of the suppliers or their employees; (b) any defect in or failure of any vehicle, equipment, or instrument owned, operated, or otherwise used by any of these suppliers; (c) any wrongful or negligent acts or omissions on the part of any other party not under the direct control of the Company; (d) any cause beyond our direct control as defined by force majeure.
You agree to indemnify and hold harmless Geeta Holidays Pvt Ltd from any and all claims, damages, losses, and expenses (including legal fees) arising out of any act or omission by you or any person traveling under your booking.
6. Force Majeure
We shall not be liable for any failure or delay in performance of our obligations which is caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, government restrictions, natural disasters, pandemics, epidemics, or airline schedule changes. In such events, our obligations will be suspended, and we will not be liable for any refunds or compensation.
7. Governing Law and Jurisdiction
This agreement and all disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the laws of India. You irrevocably agree that the courts in Sonepat, Haryana, shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this agreement.
8. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not in any way be affected or impaired.
